Auction Terms

House being sold to settle the Estate of Mary Jo Willis.  Be prepared to purchase auction day as property sells ABSOLUTE.  Four percent (4%) buyer’s premium will be added to the highest bid to constitute the final contract sale price.  A Nonrefundable ten percent (10%) escrow deposit required at conclusion of auction, balance within thirty (30) days.  SHOWN BY APPOINTMENT OR AT OPEN HOUSE, SUNDAY, JULY 9, 2-4 P.M. House is move in ready with the exception of the cabinetry in the kitchen which will be the responsibility of the new owner. Bidder should have financing in place for a timely closing within thirty (30) days.  Successful bidder will be required to sign a contract of purchase and submit the required 10% escrow deposit immediately at the conclusion of the auction.  Balance to be paid to closing agent within thirty (30) days by cashier’s check.  Escrow check should be made payable to Gaines Dickenson Escrow Account.  Escrow deposit will be placed in escrow account the morning after the auction.  In the event of default by the Purchaser, said escrow deposit whall be payable to the Seller as liquidated damages.  This provision shall not preclude the Seller from pursuing any other legal remedy against the Purchaser.  Real Estate Taxes for 2017 will be prorated as of closing between Purchaser and Seller.  All prior years real estate taxes are the expense of the Seller and shall be paid by the Seller at closing if not previously paid.  Seller will be responsible for Deed of conveyance and grantor’s tax.  Purchaser shall be responsible for all other expenses required to close the transaction to include points, title search/insurance, attorney’s fees, recording fees, and related expenses as may be required by Purchaser’s lending institution if applicable.  Seller shall provide a warranty deed.  It is the responsibility of the Purchaser to obtain a title examination at his/her own expense.  County/town ordinances & zoning may apply.  It is up to the Purchaser to inspect property being sold and referred to in this contract and accept the property in its’ present condition. The Seller and Purchaser acknowledge that in the sale of real property, the auction firms have the responsibility to offer equal service to all clients and prospects without regard to race, color, religion, national origin, sex, elderliness, familial status, sexual orientation, or handicap as well as all classes protected by the laws of the United States, the Commonwealth of Virginia and applicable local jurisdictions.
