BOTH HOUSES SELL AS A WHOLE ON 1.84+/- ACRES ALONG WITH THE ADDITIONAL SEPTIC INSTALLED FOR A TWO BEDROOM DUPLEX. PROPERTY SELLS SUBJECT TO CONFIRMATION BY A MOTIVATED SELLER.  PROPERTY SELLS AS IS-WHERE IS WITH ANY AND ALL FAULTS.  IT IS THE RESPONSIBILITY OF THE BIDDER/PURCHASER TO INSPECT THE PROPERTY  BEING SOLD AND ACCEPT THE PROPERTY IN ITS’ PRESENT CONDITION INCLUDING ANY STRUCTURES THEREON.  PURCHASER ACKNOWLEDGES THE DECISION TO PURCHASE IS BASED ON HIS/HER OWN ASSESSMENT AND DUE DILIGENCE OF THE PROPERTY AND IS RESPONSIBLE FOR HIS/HER OWN RESEARCH IN REGARD TO LOCATION, CONDITION, AND SUITABILITY OF PURPOSE. BY REGISTERING AND ACCEPTING A BID NUMBER AND BID PACKET, PURCHASER AGREES TO COMPLY WITH ALL TERMS AND CONDITIONS INCLUDING ANNOUNCEMENTS MADE PRIOR TO THE AUCTION.  IF THE ANNOUNCEMENTS SHOULD CONTRADICT THE WRITTEN OR VERBAL INFORMATION, THE ANNOUNCEMENTS WILL PREVAIL AND BE ADDED TO THE TERMS AND CONDITIONS AS AN ADDENDUM AND WILL SUPERSECE PREVIOUS CONFLICTING STATEMENTS.  IT IS UNDERSTOOD BY THE PURCHASER THAT GAINES DICKENSON AUCTIONEERS, INC. AND ADAM WILSON AUCTIONEERS, LLC., REPRESENT THE SELLER.

BIDDING & SIGNING OF THE CONTRACT OF PURCHASE IS NOT CONTINGENT UPON THE BIDDER/PURCHASER OBTAINING FINANCING.  THE BIDDER/PURCHASER SHOULD HAVE FINANCIAL ARRANGEMENTS IN PLACE, IF APPLICABLE, PRIOR TO BIDDING/PURCHASING TO INSURE CLOSING IN A TIMELY MANNER. 

PROPERTY IS BEING SOLD SUBJECT TO SUCH CONDITIONS, RESERVATIONS, RESTRICTIONS, RIGHT-OF-WAYS, AND EASEMENTS OF RECORD INCLUDING UTILITY EASEMENTS, TO THE EXTENT THAT THEY MAY LAWFULLY APPLY TO THE PROPERTY.  COUNTY ORDINANCES APPLY. 

NO PERSONAL PROPERTY INCLUDING APPLIANCES IS BEING CONVEYED WITH THE REAL ESTATE. 

PURCHASER WILL  BE REQUIRED TO SIGN A LEAD BASED-PAINT AND LEAD BASED HAZARD DISCLOSURE IF APPLICABLE WHICH WAVES THE OPPORTUNITY TO CONDUCT A RISK ASSESSMENT OR INSPECTION FOR THE PRESENCE OF LEAD-BASED PAINT AND/OR LEAD-BASED HAZARDS TO STRUCTURES BUILT PRIOR TO DEC 1978.

THE SUCCESSFUL PURCHASER WILL BE REQUIRED TO SIGN A CONTRACT OF PURCHASE. A BUYER’S PREMIUM OF FIVE PERCENT (5%) WILL BE ADDED TO THE CONFIRMED BID TO CONSTITUTE THE CONTRACT SALE PRICE.  A TEN PERCENT (10%) ESCROW DEPOSIT OF THE CONTRACT SALE PRICE WILL BE DUE AT THE CONCLUSION OF THE AUCTION AND WILL BE PLACED IN AN ESCROW ACCOUNT AND HELD UNTIL CLOSING AT WHICH TIME THE DEPOSIT WILL BE DELIVERED BY CASHIER’S CHECK TO THE CLOSING AGENT TO BE APPLIED TO THE BALANCE DUE.  IN THE EVENT OF DEFAULT BY THE PURCHASER ESCROW DEPOSIT SHALL BE PAYABLE TO THE SELLER AS LIQUIDATED DAMAGES.  THIS PROVISION SHALL NOT PRECLUDE THE SELLER FROM PURSUING ANY OTHER LEGAL OR EQUITABLE REMEDY AGAINST THE PURCHASER. 

ALL PRIOR YEARS REAL ESTATE TAXES ARE THE EXPENSE OF THE SELLER AND WILL BE PAID AT CLOSING IF NOT PREVIOUSLY PAID.  2018 REAL ESTATE TAXES WILL BE PRORATED AS OF DATE OF CLOSING NOT.  SELLER WILL BE RESPONSIBLE FOR REQUIRED GRANTOR’S TAX AND DEED OF CONVEYANCE.  PURCHASER SHALL BE RESPONSIBLE FOR ALL OTHER EXPENSES REQUIRED BY THE LENDING INSTITUTION IF APPLICABLE.
